Breezy Point Property Transfer Requirements
You must have a complying septic system prior to the transfer of the tile. How do we properly transfer property in Aitkin County?
1. If you do not know if the septic system is complying, you must have a compliance inspection conducted on the septic system. This inspection must be performed by a licensed inspector. These individuals are not employees of Crow Wing County. A list of Licensed Designers and inspector’s can be obtained at the Crow Wing County Planning and Zoning Office. If the septic system is conforming, the licensed individual will give you a Certificate of compliance form.
2. If you know the septic system in non- complying or if a compliance inspection determines the septic system is non-complying one of the following must be done :
· A permit can be obtained for the installation of a new septic system; this requires an approved design prior to applying for the permit.
· 1.5 times the bid amount for the installation of a new septic system can be escrowed. A copy of the escrow agreement is to be submitted to the planning and zoning office.
· A signed agreement to upgrade form can be submitted
3. For property with out buildings or buildings with no running water, a sworn affidavit form must be submitted.
All non- complying septic systems must be brought into compliance with in 10 months. This is required by Minnesota Statutes 155.55.Prior to the recording of the deed, a property transfer notification form must be completed between the Buyers and the Sellers of the property. This form and a copy of one of the forms in #1, #2, and #3 above must be brought to the Planning and Zoning office for signature and approval. The property transfer notification form can be obtained in the Planning and Zoning office.
For property that transfers during the winter months, a Winter Release of Compliance Inspection Form will provide the necessary paper work for the completion of the property transfer notification form.
