Crow Wing County can not make a determination as to weather or not a lot is build able with out a formal Land Use Permit request. A number of factors will need to be assesses to determine a parcel’s development potential. Below are some questions that may help landowners and potential buyers.

1.      When was the parcel created, was it created legally? Newly created lots need to meet current Ordinance requirements, and should have soils work on file to make sure the land subdivision is legal. Multiple lots, though they may have separate parcel numbers, may be considered one piece of land for the purpose of sale or development.

 

2.      What type of soils exists on the lot? The types of soils determine what type of septic system can be placed on the property. The type and size of the septic system will determine what type and size of structure can be supported. Septic designers are trained, licensed and bonded through the State of Minnesota and can do soil borings that will determine the soil type and area needed for septic system location. Soils also determine construction restrictions such as wetlands, erodable

      soils and bluffs.

 

3.    What is the land Zoned? Please note that the Tax    classification is not the same as the Zoning classification of the land for the purposes of sale or development. The zoning classification will dictate the allowed uses for the property and required setback distances for structures and septic components.

 

4.    Do you intend to use the land for commercial or personal purposes? If you intend to build a structure, you should decide what type and size. You will need to know if the structure(s) you intended to build can meet all the required setback distances from the road, property lines, and septic components. If setbacks can’t be met, a variance is required before a land use permit can be applied for. In addition there are limits on impervious surface coverage allowed, which will include all surfaces that shed water (driveways, structures, a percentage for septic drainfield, ECT.) 

 

5.   Is the property in an area near a river or lake that has designated floodplain of floodway? Federal restrictions prohibit building and land alteration in the floodway of major rivers. In the floodplain, structures must be elevated so as not to risk property damage or personal safety during flooding events.
